I am one of three landlords who each own a flat in a house, and share responsibility for building insurance and general repairs. Flats are numbered A,B, and C.
At present we have roof gutters in need of cleaning and probably repair, with water pouring down from them. Our insurance agent tells us we cannot make a claim as this is a result of ‘wear and tear’. So we are making arrangements between ourselves to fix the gutters, with money coming from the common fund we contribute to.
However, water coming from the gutters splashes onto the wall of flat B, causing serious problems with damp on the inside wall. The insurance probably won t pay for this either.
My question is: should the landlord of flat B pay for the damages to his flat resulting from this? Or is it the legal responsibility of all three landlords, as it results from ‘their’ broken gutters?

It sounds like all three landlords are equally responsible to repair the damp issue, since the damage has been done by the guttering, which has the role to protect all the building.
