My former tenant was evicted, in accordance with COVID-modified protocol, for 11 violations of the tenancy agreement. They are now suing for emotional damage associated with the eviction and frivolous issues (faucet drip) addressed two years ago. How do I protect myself?

Thanks so much Simon. This makes perfect sense. This matter seems to be frivolous; a blatant, menacing, malicious attempt to blackmail and extort money for the past tenant’s financial gain.

I can assure you that claims for ’emotional damage’ rarely – if ever stand up in court – it has to be provable.

If the tenant is suing sadly you have to defend the matter and that is end of the matter when the matter is determined by the court.
