Noise from 1st floor neighbours because of hardwood floor

Hi,

Just moved into my ground floor flat and there is a huge amount of noise coming from first floor flat. They have installed hard wood floorboards removing the original carpet a few years before I moved in. I checked their lease and it specifies that they need to have carpet. Considering the hardwood floor is in clear breach of their lease is there anything I can do? They own a share of freehold and so do I. There is also another freeholder on 2nd floor.

What are my option?

Can I sue them?
