I am a reluctant landlord of only one property who pays an agent to fully manage it. My tenants have not been in touch since about the end of July despite many attempts by the agent to contact them. They made a rent payment of £100 at the beginning of September remotely. We could not get access to do the gas safety check as they used to have dogs and the contractor felt it was unsafe to go in. The gas was capped off and the contractor noticed noone seemed to be living there so the agent posted an abandonment notice which warned of changing the locks. This was done and the agent inspected the property which is terrible condition (fleas, drug equipment, ripped up flooring etc.) but contains a lot of the tenant\’s property, things like baby clothes and a sofa but no beds. I\’m not 100% sure they have abandoned it though it does seem likely. They owe 4.5 months rent. Their next of kin do not know where they are or are or are not responding. The agent has now served a section 8 notice for rent arrears. The agent assures me that the house will be mine again when this notice expires but I\’m not sure and need to get this right as with all this trouble we just want to sell it.
Wise seeking advice on this matter. We have seen some cases, where it would seem tenants have vacated the property and in turn landlord has changed locks and taken possession of the let property. Only later for the tenant to claim unlawful possessions and tenant claiming they had the crown jewels on the let property which have been disposed off or stolen. For this reason, we advise that you have the blessings of the court. Issue a possession claim under seection 8 and obain a possession order.
